ACTIVITY 8.3

By definition a multi-agency team is made up of several organisations. Does this mean that information cannot be shared with other team members? Write down what you think are the boundaries to sharing information. What checks and balances are in place to ensure that personal information is respected?

Comment

Some staff may feel relatively at ease sharing information between statutory organisations but be more reticent about being open with workers from other sectors or with volunteers. There is no rationale for this; a team cannot collaborate effectively if important information is kept secret or only partially shared. Goble (2008, p132) tells us that a collaborative culture requires a commitment to ensure that the correct information is shared at the right time and in the right format among the people who need to know in order that the best outcomes can be achieved for the service user.

You need to ask permission to share personal information and explain what you will share with whom and the purpose of sharing it. It is good practice to ask a person to give you written, signed permission to share their information and to state on this with whom they agree or do not agree to share the information. If someone lacks the capacity to consent to the sharing of their information, section 5 of the Mental Capacity Act 2005 (DoH, 2005) allows this to take place as long as it is in the best interests of the person. On occasions you may find yourself with a legal obligation to share information without the person’s consent (for example, if a vulnerable person is at risk of harm) but in these circumstances you would generally inform the person that you were going to take this action.

Fletcher gives us six questions to consider each time we are intending to share information or break confidentiality.
